The SCRA was formerly referred to as the Soldiers\u2019 and Sailors\u2019 Civil Relief Act and was enacted in 2003. It aims to protect military personnel on active duty by limiting actions that can be taken against them. It\u2019s also intended to reduce, postpone or stop any civilian obligations while a person is on active duty.<\/p>\n\n\n\n<p>This law allows military personnel to focus on their military duties by reducing financial and legal burdens that might otherwise affect them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-does-the-scra-cover\">What does the SCRA cover?<\/h2>\n\n\n\n<p>The SCRA extensively protects active military personnel and covers many different factors. Some of the most-used features include limits on interest rates, foreclosures and income taxes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-interest-rates\">Interest rates<\/h3>\n\n\n\n<p>Under the SCRA, creditors must limit the interest rate for military personnel to <a href=\"https:\/\/www.consumerfinance.gov\/consumer-tools\/educator-tools\/servicemembers\/the-servicemembers-civil-relief-act-scra\/#:~:text=If%20you%20took%20out%20an,of%206%20percent%20per%20year.\" target=\"_blank\" rel=\"noreferrer noopener\">6 percent per year<\/a>. This maximum also applies to debts incurred before military service. Any interest that\u2019s higher than this maximum must be forgiven by the creditor.\u00a0<\/p>\n\n\n\n<p>This limited interest rate applies to credit cards, mortgages, loans and more. However, this rule only applies to federal student loans taken out after August 14, 2008. For mortgages, the reduced rate of 6 percent will continue for one year after active-duty service ends.&nbsp;<\/p>\n\n\n\n<p>A service member\u2019s interest rate isn\u2019t automatically reduced when they enlist in the military. Instead, the individual needs to reach out to their creditor with a copy of their military active-duty orders and a written request to abide by the 6 percent interest maximum.&nbsp;<\/p>\n\n\n\n<p>There are some exceptions to the rule. For example, if a creditor appeals the request and the court finds that the service member\u2019s ability to repay isn\u2019t affected by their active duty, the service member may have to pay the original interest rate.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-foreclosures-and-repossessions\">Foreclosures and repossessions<\/h3>\n\n\n\n<p>Under the SCRA, service members are <a href=\"https:\/\/www.lexingtonlaw.com\/blog\/credit-101\/what-rights-and-protections-do-members-of-the-military-have-while-they-are-deployed.html\" target=\"_blank\" rel=\"noreferrer noopener\">protected against default judgments,<\/a> including foreclosures and repossessions. When a service member doesn\u2019t appear in court because they\u2019re away on active duty, the court can\u2019t issue a judgment.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-foreclosures\">Foreclosures<\/h4>\n\n\n\n<p>If the service member purchased a home before their active-duty service, a lender can\u2019t seize or foreclose on the house. The only exception is if the lender receives a court order for foreclosure. Some states don\u2019t need a court order to foreclose on a home (nonjudicial foreclosures), but under the&nbsp;SCRA, service members are protected in these states, too.&nbsp;<\/p>\n\n\n\n<p>Additionally, service members receive \u201ctail coverage,\u201d which is an extended period of protection after returning from active duty. The foreclosure postponement lasts for 1 year after active-duty service ends.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-repossessions\">Repossessions<\/h4>\n\n\n\n<p>Lenders can\u2019t repossess property\u2014such as vehicles\u2014for nonpayment or under contract termination due to payment gaps. This applies to any missed payments during the service member\u2019s active-duty service. However, this protection only applies if:<\/p>\n\n\n\n<ul>\n<li>The service member purchased or leased the personal asset before beginning active duty.<\/li>\n\n\n\n<li>They made at least one payment, or put down a deposit, on the personal asset before starting active duty.<\/li>\n<\/ul>\n\n\n\n<p>However, if a lender receives a court order for repossession, it can bypass SCRA protection.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-income-taxes\">Income taxes<\/h3>\n\n\n\n<p>If a service member can show that their military service impacts their ability to pay their income taxes, they can be deferred. This rule applies to the IRS and state and local tax authorities. Additionally, the service member can\u2019t be charged any interest or fees for the income tax deferral.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-small-businesses\">Small businesses\u00a0<\/h3>\n\n\n\n<p>If a service member owns a small business, creditors can\u2019t come after them for business obligations or debts while the individual is on active duty. The&nbsp;SCRA protects the individual\u2019s military pay and nonbusiness assets from the creditors associated with the small business.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-credit\">Credit<\/h3>\n\n\n\n<p>When a service member asserts their rights under the SCRA, <a href=\"https:\/\/www.consumerfinance.gov\/ask-cfpb\/im-in-the-military-can-exercising-my-rights-under-the-scra-hurt-my-credit-score-en-1371\/\" target=\"_blank\" rel=\"noreferrer noopener\">creditors can\u2019t respond by revoking or denying credit or changing the credit terms.<\/a> For example, if an individual invokes the 6 percent interest rule, the creditor can\u2019t respond by reducing their credit card limit. But if a service member misses a payment, the creditor can report them to credit reporting companies. This late payment may then show up as a negative item on their credit report and may <a href=\"https:\/\/www.lexingtonlaw.com\/bad-credit\/credit-scores-and-the-military\" target=\"_blank\" rel=\"noreferrer noopener\">hurt their credit.\u00a0<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-other\">Other<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-voting\">Voting<\/h4>\n\n\n\n<p>Service members keep <a href=\"https:\/\/www.americanbar.org\/groups\/legal_services\/milvets\/aba_home_front\/information_center\/servicemembers_civil_relief_act\/taxation_and_voting_issues\/voting_rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">the right to vote in their state of residency<\/a>, even when they\u2019re stationed for active duty in another state or country. They don\u2019t need to change their voter registration and can vote in their state of legal residence.\u00a0<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-civil-judicial-proceedings\">Civil judicial proceedings<\/h4>\n\n\n\n<p>Any civil judicial proceedings, including family law proceedings, are postponed under the SCRA. If it\u2019s found that a defendant service member hasn\u2019t been able to attend court because they\u2019re on active duty,\u00a0<a href=\"https:\/\/www.justice.gov\/servicemembers\/servicemembers-civil-relief-act-scra#:~:text=The%20SCRA%20states%20that%20for,interests%20of%20that%20defendant%20servicemember.\" target=\"_blank\" rel=\"noreferrer noopener\">the court can\u2019t enter a default judgment<\/a> against them. The service member must then appoint an attorney to represent their interests as a defendant.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-life-insurance\">Life insurance\u00a0<\/h4>\n\n\n\n<p>A life insurance company can\u2019t increase payments or end coverage because an individual is on active duty. An exception to this rule is natural premium increases that come as a result of age. Insurance companies also can\u2019t limit or restrict any type of coverage due to active-duty service.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-who-is-eligible\">Who is eligible?<\/h2>\n\n\n\n<p>Now that you know what SCRA is, you might wonder who\u2019s eligible for this protection. The SCRA covers <a href=\"https:\/\/militarybenefits.info\/servicemembers-civil-relief-act-benefits\/\" target=\"_blank\" rel=\"noreferrer noopener\">all active-duty military members,<\/a> including:<\/p>\n\n\n\n<ul>\n<li>Army<\/li>\n\n\n\n<li>Marine Corps<\/li>\n\n\n\n<li>Air Force<\/li>\n\n\n\n<li>Space Force<\/li>\n\n\n\n<li>Coast Guard<\/li>\n\n\n\n<li>Navy<\/li>\n\n\n\n<li>Reserves and National Guard<\/li>\n\n\n\n<li>Commissioned officers on active duty with the Public Health Service or the National Oceanic and Atmospheric Administration&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>A service member\u2019s eligibility begins the first day of their active-duty service commitment and ends between 30 and 90 days after finishing active duty. For some aspects covered by the SCRA, the\u00a0protection can extend <a href=\"https:\/\/www.consumerfinance.gov\/consumer-tools\/educator-tools\/servicemembers\/the-servicemembers-civil-relief-act-scra\/#:~:text=You%20can%20request%20an%20interest,you%20exercised%20your%20SCRA%20rights.\" target=\"_blank\" rel=\"noreferrer noopener\">up to 180 days<\/a> post-active duty.\u00a0<\/p>\n\n\n\n<p>SCRA protections can apply to the spouses and children of service members or other individuals who relied on the service member for 50 percent or more of their financial support. This support had to start at least 180 days before using SCRA protections.&nbsp;<\/p>\n\n\n\n<p>Service members who are uncertain about the coverage for themselves or their loved ones can contact the Legal Assistance Office at their base.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-waiving-your-rights\">Waiving your rights<\/h2>\n\n\n\n<p>A service member can waive their rights under the SCRA with a written document signed after their military service period starts. Waiving your SCRA rights before entering military service makes the action void.&nbsp;<\/p>\n\n\n\n<p>While you can waive your SCRA rights, it\u2019s generally not recommended. Consult an attorney before waiving rights, and read the documents carefully before signing.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-to-take-advantage-of-the-scra\">How to take advantage of the SCRA<\/h2>\n\n\n\n<p>The majority of your rights under the SCRA require you to take some form of action before protection takes effect. Tax authorities, lenders and courts often don\u2019t know when a person is on active duty. To take full advantage of the SCRA, you should first understand all the benefits and your rights.&nbsp;<\/p>\n\n\n\n<p>For example, to get a refund on certain interest and fees, you have to actively request relief by submitting paperwork so they can verify your active-duty military status. It may not be an automatic process, but it\u2019s worth the effort.&nbsp;<\/p>\n\n\n\n<p>In general, when you\u2019re applying for SCRA benefits, you\u2019ll need to provide the following information:&nbsp;<\/p>\n\n\n\n<ul>\n<li>Account number<\/li>\n\n\n\n<li>Start date of the active-duty service<\/li>\n\n\n\n<li>Request for relief in accordance with the SCRA<\/li>\n\n\n\n<li>Copy of active-duty orders<\/li>\n<\/ul>\n\n\n\n<p>Certain companies may give you extra SCRA benefits on top of everything else. One large bank offers active-duty personnel interest rates that are <a href=\"https:\/\/veteran.com\/companies-who-support-the-scra\/\" target=\"_blank\" rel=\"noreferrer noopener\">2 percent lower<\/a> than what the SCRA requires. Many other creditors and financial institutions also offer additional benefits.<\/p>\n\n\n\n<p>By understanding your SCRA benefits, you can set yourself up to take full advantage of everything offered. This can help you significantly <a href=\"https:\/\/www.lexingtonlaw.com\/blog\/finance\/money-guide-for-veterans.html\" target=\"_blank\" rel=\"noreferrer noopener\">when you return from active duty<\/a>.\u00a0<\/p>\n\n\n\n<p>If you\u2019re about to leave for active duty, knowing where your credit stands can give you peace of mind.
